About breaking a BOND Agreement

Good Evening to all,

I am working currently in an It firm. definitely everybody is aware of attrition problem in this sector. So in order to curb this problem, the company has introduced BOND phenomena of minimum 1 year stay in the company. and an employee can only leave company after one year by giving 2 months notice. Over and above they take your original documents or 1 month salary on hold as a security deposit. If any employee breaches the agreement, that employee will be liable to pay 50,000 Rs or three month salary back to the company. Otherwise company will file a civil case in the court against that employee.

Now the question is one of the employee has decided to left job due to social issues serving two months in the company. I as an HR executive, had been told to issue him notice to pay 3 months salary back to the company as per agreement. Now is that justifiable? That employee will be paying one month salary extra which he has not served.......

I mean.....this sums up that employee worked for free here.....instead of earning 2 month salary he gave 3 months salary back to the company...

Also I would like to companies really file cases against employees in the court? How far it is safe to break the BOND??
