01) (Domestic Operation):

Timings : Day shift
Salary Details: 7.5K-12k+Incentive

Eligiblity:Candidate having 1yrs experience of Telecalling / Telesales (in DSA Or Domestic BPO Outbound calling process).
Marketing of our Paid Services to Existing Clients/New Sales.
No cold calling, No field, only office job.

Can Resigned Employee be declared absconding?

Hi ,
I am Rahul I resigned from an IT company. I was confirmed recently in that company. There was provision of 3 months notice period for confirmed employee. In my offer cum appointment letter it was mentioned either party can terminate this employement agreement by giving three month basic salary in lieu of notice period.No-where it was mention that it is the sole discretion of the company to take any decision.But after my resignation when I aksed for what amount i need to pay they said you have to serve the 3 month notice period .if you dont we will declare u absconding and terminate your services.but when i told them about my appointment letter's terms and condition they said it is understood and we are not required to write each and u have to serve the notice period. i worked till the last day of month in which i resigned.My salary for that month was blocked and was not paid to me .so on first day of next month i written mail to HR saying that plz consider last day of month as my last day and do my full and final settlement.After that i recieved a letter to rejoin the office otherwise i will be declared absconding. Along with reply to that letter i voluntarily sent a cheque by calculating amount sufficient for the notice period to them.I also sent them email communication happened so far with them which include my resignation mail along with their acceptance mail.In acceptance mail my reliving date was not clarified.after that i received another letter .to which i reply by telling them same thing again.after that they had sent to me my termination letter along with my full and final settlement sheet in which they had asked for some more amount. a cheque for this amount i had sent to them now.
So my question are as follows:
1) what should i do to get my normal reliving and experince letter?
2) should i sue my employer for the breach of employment agreement if yes how strong would be my case?.
3) Can a resigned employee be declared absconding and can he be terminated ?
4) what advice would you give me?
