Non solociting agreement-Legal?

Posted: 02 Mar 2010 04:11 PM PST

Hi,
When I was sent abroad for an onsite assignment I had to sign a non - soliciting agreement by which i should not join the customer organisation or competetor upto one year after leaving the company. Already more than 2 years completed at onsite and now I had applied for a suitable position in the customer organisation, and they are willing to hire me. My company does not allow me to consider this option stating the aggreement. I would like to know is it legaly correct to restrain me from joining the customer company. Thanks in advance for the response

HI Everyone in cite hr community
This is the worst exp in my life I ever wanted to share with fellow members here .Dont know how to start with. Like other career aspirants I have done Full time MBA in HR in 2009 after working for almost two years in corporate plus I have two years of teaching exp which I don't show on resume.I Started my post qualification career in one Recruitment consultancy based in Delhi as recruiter in August 2009.Within two months I got opening in one reputed ITES MNC in Gurgaon as HR Assistant ( Generalist profile)in August 2009.I was so happy I cant express in words. But suddenly it came as a shock after 5 months when on 1st February at 9 pm I have been asked to resign due to cost cutting or we can say retrenchment. I got confirmation within one month for my performance & for that got one month extra salary from the co. I tried almost everything possible under the sun to get into job but failed to do so even when for a good profile I am ready to work in any part of the country.
My career is at stake today and I don't know about future. I am unemployed from last 30 days don't know because of what reason,What experience I will show in My resume that also I don't know. Nowadays frustration is taking place instead of positive thinking. Sometimes It reminds me like am a looser. Can you advice me how to deal with this type of mental situation…
